Who knew? THE WSL’s EVP is connected to the Monica Lewinsky scandal? No way that dude surfs.

A listener did a little research and sent this over to us…

Jonathon S. Marshall is a lawyer, and the EVP and General Counsel of the ASP/WSL. Paul Speaker’s right hand man.

A little online research revealed that Jonathon S. Marshall was COO & Gen. Counsel for RKO Pictures from 2001 -2006 ; where, as it turns out, beginning in 2003, Paul Speaker was the President of RKO Pictures and during Speakers tenure at RKO Pictures the company did very well.
Production and distribution grew ten fold. He was a success at RKO. They were both a success.

But the relationship between Paul Speaker and Jonathon Marshall goes back to 1998 where Speaker and Marshall were again teamed up with an independent entertainment company called The Shooting Gallery that produced such Academy Award-winning films as “Sling Blade” -1996 – and “You Can Count on Me, – 2000.

However during the time Speaker and Marshall were at The Shooting Gallery the company went spectacularly bust, because it (and I quote): “became more focused on the fast profits and expansion of new-media endeavors than good old-fashioned film-making. They had a radical philosophy change from being a tightly run, fiscally conservative company that watched every dime to turning around and trying to create a vast dotcom company.

In 2003 Jonathan Marshall was a defendant, along with a number of other defendants (but not including Speaker) from THE SHOOTING Gallery; sued by banks for misleading the banks by preparing and submitting a series of false and misleading financial information regarding among other things The Shooting Galleries solvency, collateralized assets, even its viability all of which portrayed The Shooting Gallery as a highly solvent and experiencing solid financial growth. They misrepresented and concealed information; To the tune of a 20 million dollar credit extension by the banks.

How’s this quote: “Not only were the defendant’s financial representations false but throughout the entire credit relationship TSG was either insolvent or in the vicinity of insolvency.”

Marshall and others were also sued in bankruptcy court in an attempt to recover 30 million dollars in losses by trustees of the The Shooting Gallery. Among other things the lawsuit claims that Marshall and the defendants simply headed to the exits failing to put the company in to bankruptcy, but also failing to preserve TSG books records, assets and on e took steps to prevent employees- who were fired en masse via email with out final paychecks, from damaging TSG property upending file cabinets, destroying or removing tsg computers and records – all of which substantially impaired the value of the Debtors estates.

All said and done a 2001 LA times article stated that the Shooting Gallery lost over $70million dollars. Shooting Gallery’s creditors lined up around the block. Forty-five have already sued Shooting Gallery, ranging from its bank and law firm to former employees, former film associates, landlords and leasing companies to the mother of Shooting Gallery executive C.J. Follini, who lent the company $500,000.

All of this simple online research is interesting in light of the work Stu Nettles did in his three part article the “ASP ; It’s On. But Who’s Watching.” Plus, the switch from YouTube to the new platform, conveniently hiding the numbers of people actually watching.

So we have Speaker and Marshall driving the WSL– both who had great success at RKO–but at least in Marshall’s case- he has allegedly been part of some alleged cooking of the books, cooking of information, and cooking of data to gain funding for a business.

Is Marshall baggage that the WSL doesn’t need? Or, is this simple business? Heck, people get sued all the time. Probably not the best situation as WSL courts potential sponsors, partners, etc. etc.
